On 1 June 2025 the government introduced a new law making it illegal in the UK to sell or supply single-use vapes under the Environmental Protection (Single-use Vapes) (England) Regulations 2024.
This ban includes any 'disposable' vapes which are not refillable and which contain a battery which cannot be recharged.
The new law is intended to reduce the environmental harm caused by the waste from these products when they have been discarded or disposed of, and also to try and reduce vaping among young people.
Wirral Council is a regulator for the purposes of enforcing these regulations – this means that the council are responsible for enforcing the new law in its local area.
As a regulator, Wirral Council are required to have an enforcement policy.
This policy must:
Include our use of fines, notices and other penalties contained in the regulations
Be consulted on
Be published once it is finalised
A draft enforcement policy has been produced, based on a national template, and can be viewed in the documents section on this page. There is also a summary document available. Please read the draft enforcement policy or summary before completing the below survey.
This consultation is your opportunity to give us your feedback on the draft enforcement policy.
Once you have completed the survey, the feedback provided will be reviewed and considered for the final version of the policy. The final version of the policy will then be reported to Wirral Council’s Tourism, Communities, Culture & Leisure (TCCL) Committee for approval.
Currently the Trading Standards Service are dealing with any supply of single use vapes via alternative enforcement powers until the TCCL Committee have considered the policy.
