What is a moving traffic offence?
Moving traffic enforcement is a way of managing moving traffic behaviours by enforcing fines and penalty charge notices for motorists that breach the restrictions that are in place.

How will the council enforce these offences?
Automatic Number Plate Recognition (ANPR) cameras will be installed at the sites to be enforced and Penalty Charge Notices (PCNs) will be issued by post to the registered keeper of the vehicle.
What is the reason behind undertaking moving traffic enforcement?
We have a duty to make sure traffic moves freely and quickly on our roads and the roads of nearby authorities. By undertaking moving traffic enforcement we are carrying out this duty. Our primary reasons for enforcing remain:
Why are you consulting the public on the powers to adopt moving traffic offences?
We want to make sure that our plans reflect the views of the community where the changes will be implemented.
Is there a specific location (or multiple locations) where the enforcement will take place?
If approved, our resulting application is successful, and we are granted these powers from the DfT, the council will be able to enforce them anywhere in Wirral.
Initially, however, we are looking at undertaking enforcement at Green Lane and Greenleas Close in Wallasey to help support the existing School Streets scheme at this location.
Why has this location been chosen?
This location has been chosen due to Greenleas Primary School being the first school to introduce a School Streets scheme in Wirral (for more information visit the Greensleas school street consultation page). As part of the scheme, there are signs in place to advise motorists of the traffic restrictions in place at this location. By considering this location, the council will be able to provide enforcement and therefore additional support to the scheme.
Will there be better road markings and signs to make people aware of the changes?
In order to enforce Moving Traffic Offences there are regulations on the number of signs that need to be displayed.
We've carried out surveys at the Greenleas Close and Green Lane in Wallasey and the site complies with regulations.
What is the enforcement penalty?
A Penalty Charge Notice (PCN) will be issued for Moving Traffic Offences.
The penalty will be £70, however, this will be reduced to £35 if paid within 14 days.
Following DfT (Department for Transport) guidelines, there will be a six-month warning notice period where no fines will be issued for first time non-compliance.
Will this cost me money?
No, this will only cost the motorist money if they are served a fixed penalty notice for not complying with the new restrictions.
What will happen to the income generated by fines?
Any income from fines will be used:
To recoup costs of enforcement with any surplus income being used in accordance with the legislation but may include;
• public transport provision.
• to pay for highway improvement projects.
• to pay for environmental improvements in the Council’s area.
How do I suggest another location?
You can use the survey on this site to suggest other locations where we could look to enforce Moving Traffic Offences.
We are encouraging residents to tell us which other areas in Wirral this may benefit as we are confident that this enforcement will help to make roads safer for those walking and cycling, reduce congestion and improve journey times as well as air quality.
Any locations suggested will be looked into to see if they are suitable and, should our application to obtain powers to enforce Moving Traffic Offences be successful, included at a later date.
Could these powers be applied to cycle lanes in the future?
Yes these powers could be used to enforce mandatory cycle lanes. We will look at this as part of future phases. If there are any locations in particular that you feel may benefit from this, please identify this in the suggestion box with the survey on this site.
Can more speed cameras be added?
Speeding is a criminal offence and is enforced by Merseyside Police, not by the Council. Moving traffic restrictions (such as banned turning movements, yellow box junctions etc) are classed as civil offences and these are what we are consulting on.
Why aren't you enforcing against pavement parking?
The Council is waiting for the Department of Transport to release new guidance and legislation around tackling pavement parking.
